工作时间到现在有470小时,11月份发现怀孕后就告诉了老板,12月在家休息了一个月,因为早孕反应。
1月份被老板叫回去继续上班,并告诉她打算做到5月份,因为7月孩子出生,她当时没有意见。2月底他们新招了一个日本女孩,3月初也就是上周5突然通知我,两个星期后让我走人,让我自己quit,因为我肚子大了,不能当服务生,我马上说我还想做150个小时,筹够EI时间就自己QUIT,我身体健康,也比较年轻,28岁,医生说我可以做到生,但是他坚决不同意,找借口说有客人已经再问我是不是怀孕了,说这个工作不适合我了。我又提议是不是可以做别的工作,她也给拒绝了,后来我没有办法,让她给我LAY OFF LETTER,她当时脸就黑了,说你生完孩子还要回来上班吗?我说不了,但是我现在还可以做一直到生。他就不理我了,然后和另外一个同事说,在想别的办法,我现在的问题时,这种情况他能不能LAY OFF 我,我还有没有办法拿到EI,希望各位前辈,有经验的同胞出出主意。
First, how did your boss pay you? check or cash? Is the EI deducted from your income? If you never payed EI before, then I am not sure you can get it. Talk to your local goverment sponsered Chinese immigrant association to get some advices.
Having baby is the most important thing, to have EI or not, doesn't really matter. So be happy no matter what.
其实我也就是想再多做150个小时左右,8刀一小时,加起来一共才1200嘛,我还干活呢?一点都不偷懒的,只是到后期可能没有正常人手脚麻利些,但是老板心肠好硬哦,一点商量的余地都没有,我最后才提出来要layoff letter 的,我原来还想,我不要你的工钱就是了嘛,我还在你那里干活,只要你给我交上EI,后来觉得我很天真,很傻。。。

用self help kits与老板协商,并不是口头沟通,而是根据劳工法,将你认为老板不合法的行为以及自己合法的要求通过书面的形式交给你的老板,注意提交的日期,老板必须在收到文件后15日内回复,然后你就可以拿着这份文件到劳工部要求他们介入了。
通常无良老板收到这份文件后都不敢让事情闹到劳工部的,除非老板认为雇员的要求是无理要求。
这个帖子到6页了,好感动有这么多的朋友关注这个事情,我的心情已经平和了,老板好歹同意我留下来,一周10个小时我就当散步锻炼身体了,能做到600小时最好了,万一后期身体不适不能做了,我也不会勉强的,一切以孩子的健康为前提条件。同时也一边留意找找周末的part time 工,这扇窗户的门关了,总有另外一扇窗户为你打开门的,我老公也开始发简历准备跳槽了。希望各位朋友移民之路越走越宽,生活更美好,全家幸福,孩子聪明,健康,可爱!!!

An employer can't fire a woman because she is pregnant . And when she returns to work, she must get back her old job or a similar job for at least the same pay.
A working pregnant woman can apply for money from EI during her pregnant. There are rules about when she can apply and how much time she can have. She may be eligible for up to 15 weeks of benefits.
