I am replying to your email of December 10, 2008, addressed to the Honourable Jason Kenney, Minister of Citizenship, Immigration and Multiculturalism, concerning the recent amendments to the Immigration and Refugee Protection Act (IRPA).
As you may be aware, on July 18, 2008, the proposed changes to IRPA became law. These changes took effect February 27, 2008, as announced on July 3, 2008 <

The Ministerial Instructions <
http://www.cic.gc.ca/english/department/media/backgrounders/2008/2008-11-28a.asp> apply only to applications submitted on or after February 27, 2008, and apply to candidates who:
* are in 38 high-demand occupations <
http://www.cic.gc.ca/english/immigrate/skilled/apply-who-instructions.asp> such as health, skilled trades, finance and resource extraction; or
* have an offer of arranged employment <
http://www.cic.gc.ca/english/immigrate/skilled/apply-who-employment.asp> ; or
* have already been living legally in Canada for one year as a temporary foreign worker or international student.
The list of 38 occupations was developed after consultations with the provinces and territories, business, labour and other stakeholders. The initial list of occupations is limited and reflects nation-wide labour market shortages. The department is currently developing an approach to regularly assess the national list of occupations to ensure that future instructions remain consistent with labour market needs. If the application meets the criteria outlined in the instructions, it will then be assessed according to the points system, which is still the same point system of 67 points.
There are many ways to immigrate to Canada. Applicants who are not eligible for the federal skilled worker category may qualify under another category, such as the Provincial Nominee Program <
http://www.cic.gc.ca/english/immigrate/provincial/apply-who.asp> , or as temporary foreign workers, which could then put them on a path to permanent residency through the new Canadian Experience Class <
