法律英语专门术语是用来准确表达特有的法律概念的专门用语。这类专门用语既有和其它各类术语相同的共性，也有其自己特有的个性。根据意义结构或语义范围，这类专门用语可分为常用术语、排他性专门涵义术语、专门法律术语和借用术语四种形式。

1.常用术语　法律英语常用术语有两种概念：第一，不明确表示特定的法律概念，语域比较广，既常用于法律语言中，也是社会日常生活各方面不可缺少的词语，在两种语域中无语义差别，而且通俗易懂。例如：conduct（行为），write（签字），witness（证明），goods（商品），individual（个人），sum（总额），signing（签署），insurance（保险），gambling（赌博），rule（规则），marriage（婚姻），divorce（离婚）等等。第二，表示特定的法律概念，但是随着应用范围的扩大和全民词汇发生密切联系而经常互相交换与影响，结果由原来只有法律工作者知晓的术语扩伸到全民词汇领域中。例如：law（法律），lawyer（律师），debt（债务），murder（谋杀），crime（罪行），prison（监狱），court（法庭），contract（合同），police（警察），will（遗嘱），fine（罚款），punishment（惩罚），sentence（判决），judgement（审判），robbery（抢劫），theft（偷窃）等等。随着法律知识的普及和法制的发展，这类术语全民化的数量会不断加大。法律英语常用术语由于法律和全民通用，所以其最大特点就是常用性及适用场合广。据此，这类术语一般文体信息较少，具有中性文体意义效果。另外由于这类术语都是常用词，所以其构词能力较强，如law lawful和lawyer， crime criminal， contract contractual，而且有的具有多义性，应用时要注意词形变化和语境。

2.排他性专门涵义术语　这种术语指排斥与法律概念无任何联系的一般涵义而保留特定的法律专门涵义的法律专门用语。这类术语有两种涵义：一是法律方面的；二是普通意义方面的。由于两种涵义截然不同，所以必须通过排斥与法律无关的普通涵义才能明晰地揭示特定的法律专门涵义。这类术语的多义现象主要是由于词义范围在历史演变中扩大或缩小而产生的。据此，可将其分为两类形式：1词义外延术语：许多专门创造的法律专门术语由于词义从原先表示的单一概念扩大到表达外延较宽广的概念而越出其使用范围，渗透到日常生活中，例如alibi是一个法律专门术语，意为“不在犯罪现场”，现在词义已扩大为“借口，托辞”，甚至还转化为动词“为…辩解”。再试看以下词义外延的例子：法律专门术语外延词义statute法令，成文法（公司、学校等的）章程，条例jury陪审团（竞赛时）评奖团code法典、法规密码，电码plead辩护恳求guilt有罪内疚2词义缩小产生的术语：与1类相反，许多法律专门术语不是专门创造的，而是由于全民的原始词义外延缩小从日常生活转用到了法律方面形成的，即在原有含有一般词义的旧词基础上赋予其表示法律概念的新义。例如日常生活用词box表示“盒，箱”之义，现在已具有法律涵义，成为法律专门术语，表示“证人席，陪审席”。再试看由于词义缩小形成的法律专门术语的例子：一般词汇词义缩小产生的术语parole（俘虏）宣誓假释complaint报怨控告，起诉exhibit展览证据，特征deed行为契约suit请求，恳求；（一套）衣服起诉；诉讼，讼案排他性专门涵义术语由于表示法律概念专门，使用频率高，所以构成法律英语专门术语的主体部分。这类术语虽然从词形看许多都是常用词，但是在语义方面由于它是由一般词义和法律专门涵义两类不同语义内容构成，所以一般只有精通法律英语的法律工作者才能懂得术语所揭示的特定法律概念，而多数人一般只了解其一般涵义。法律英语用词的最大特点就是准确。这类术语有一词多义的特点，所以在实际应用中切不能望词生义，而是一定要借助语境正确理解，以免误用。例如apology除了常用词义“道歉”外还有“辩护”之义。在He delivered a lengthy apology一句中由于缺少必要的语境无法断定apology的指称意义。如果有了语境，比如在法庭上或者在日常生活中，问题就迎刃而解了。

3.专门法律术语　这类术语因为符合术语的单义性、准确性和所表达的概念严格分化三个根本特征，所以是严格意义上的标准术语。这三个根本特征是术语和非术语的分界线，具备者为术语，不具备者为非术语。单义性要求专门法律术语必须名称单一，指称意义单一，两者完全一致以产生严格定义。例如：plaintiff（原告），defendant（被告），recidivism（累犯），bigamy（重婚罪），homicide（杀人者），affray（在公共场所斗殴罪）等就具备这些特征。这些术语名称和指称意义均单一，定义很严格，除defendant有形容词转化外甚至无词类变化。单义性的实际意义在于它可有效地防止误解，即使在较小的语境中也是如此。例如在前面提到的He delivered a lengthy apology一句中，如果apology为单义就不会发生意义无法断定现象。上述例子表明了单义性的重要性，然而许多法律英语术语却不能符合这一条件。一是由于它们同时具有法律意义和一般意义，从而形成了的多义，这一点前面已有论述，在此不多赘述。二是由于专门法律术语的定义下得过多而在术语本身内部形成了多义。例如libel就表示两种法律概念，第一种就有“诽谤、诽谤罪、文字诽谤、书面诽谤”四种释义，第二种和上面概念截然不同，表示“原告的诉状”；lexmercatoria据查就有“商法、商事法、习惯商法、商业习惯法、商人法律、商人习惯法”六种释义。单义性与准确性两者相辅相成，相得益彰。专门法律术语在自己的范围内释义如此不统一不仅破坏了单义性，而且还破坏了准确性，结果往往造成理解上的极大困难，这不能不说是一大缺憾。据此，逐步使法律术语释义统一、精确、明晰是整理审订术语应加以解决的首要问题。专门法律术语所表达的概念严格分化表明，这类术语不包含感情色彩，一般只适用于法律或与其有密切联系的语域中。严肃的法律要用严肃的语体，严肃的语体要用严谨精密的专门法律术语体现，法律英语语体严肃庄重的特点很大程度上取决于此。

4.借用术语　随着政治、经济和科技的发展，法律调整的内容越来越多，门类的划分也日趋细密，目前已发展成为一个体系庞大、门类众多、结构严密的学科。一些新的法律分支学科和边缘学科应运而生，相关领域内的专门术语大量涌入法律英语专门术语， 其中许多术语已站稳脚跟，占有非常固定的一席之地。例如：sadism（性虐待狂）源自心理学，abortion（堕胎）源自医学，artistic work（艺术作品）源自艺术，continental shelf（大陆架）源自地理学，heredity（遗传）源自生物学，ratio（比率）源自数学，incest（乱伦罪）源自社会学，monogamy（一夫一妻制）源自人口学，tariff（关税）源自经济学，average（海损）源自运输，claims（索赔）源自对外贸易，life insurance（人寿保险）源自保险等等。借用术语来源之广，数量之大是很难估计的。由于观点的不同，究竟哪些术语应真正进入法律术语行列是不能绝对化的。但是，随着法律调整内容的扩大，在传统公认的借用术语基础上，更多的借用术语进入法律术语是一种必然趋势。本节所述四种法律英语专门术语彼此之间是相互联系，相互作用，相互协调的。它们之间有特定的语义联系，构成独特的有规律的术语体系，所以，应该全面地看待其鲜明的体系性，切不可将其孤立化。
